Man sues CVS for leaking Viagra prescription to wife, ruining marriage

A New York man has filed a lawsuit against CVS Pharmacy for exposing his prescription for Viagra to his wife, which led to his “broken marriage,” reports said Monday. Michael Feinberg sued the drugstore chain for unspecified damages.

According to the lawsuit obtained by the New York Post, Feinberg went to a CVS store on Long Island to purchase a prescription for eight 100-milligram tablets of the erectile dysfunction drug, with five refills. He told a store employee, identified in court documents as “Aurula”, that he would pay for the drugs himself.

After explaining to the employee that Viagra – which can cost over $ 60 a pill – wouldn’t go through his insurance, Feinberg left.

Days after the order was filled, Feinberg said, his wife called CVS to discuss another order. During the call, the pharmacist on duty began to tell her about her husband’s prescription for Viagra.

Feinberg said the employee “unsolicited, misinformed [Feinberg’s] woman that [his] Viagra’s prescription was not covered by insurance, ”a violation of the confidentiality rules of the Health Insurance Portability and Liability Act, according to the lawsuit.

The man said in the lawsuit that his wife, known as a “third party”, was not entitled to know about the prescription of Viagra.

Feinberg said that due to the CVS employee’s indiscretion, her “marriage has broken down,” according to the New York Post. He accused CVS of negligence and said he suffered “genuine serious mental injury and emotional harm.”

In a statement, CVS spokesperson Gary Serby said: “CVS Pharmacy does not comment on pending complaints or disputes. We have policies and procedures in place to make sure we are getting medication to the right patient. … We also place the highest priority on protecting the privacy of those we serve, and we take our responsibility to protect confidential information very seriously.

Viagra is used to treat erectile dysfunction or impotence in men. The most common side effects of Viagra are headache, nasal congestion, blurred vision, photophobia (sensitivity to light), dyspepsia (indigestion). In very rare cases, the drug may cause non-arteritic anterior ischemic optic neuropathy or optic nerve damage.
